Terms of Service

These Terms govern your use of the Bricks platform. By creating an account or using our services you agree to be bound by these Terms. Please read them carefully. If you do not agree, do not use the platform.
1. About Bricks
Bricks Media Inc. ("Bricks," "we," "us") is a Toronto-based company that operates a technology platform connecting real estate agents, teams, and brokerages ("Clients") with independent professional photographers and videographers ("Photographers") for the production of listing media.
Bricks is a marketplace and platform operator. We do not employ Photographers; they are independent contractors retained on a per-booking basis. Bricks is not a photography studio and does not directly perform photography or videography services.
2. Account Registration
You must be at least 18 years old and have authority to bind yourself or your organization to these Terms. By registering, you represent that all information you provide is accurate and current.
You are responsible for maintaining the confidentiality of your account credentials. You must notify us immediately at legal@brxs.ca if you suspect unauthorized access to your account.
3. Subscription Plans and Credits
Bricks offers four annual subscription plans. Each plan grants a fixed number of monthly listing credits:
- Clay ($0/mo): No credits. All bookings billed at full retail rate. No monthly commitment.
- Gold ($179/mo, billed annually): 1 credit per month.
- Platinum ($329/mo, billed annually): 2 credits per month.
- Diamond ($599/mo, billed annually): 4 credits per month.
One credit entitles the holder to $299 off the base price of any single listing shoot. Credits apply to the base package price only — add-ons are always billed at the cash rate. All packages including Estate ($2,499) are eligible. Maximum one credit per booking. Credits may not be transferred, sold, or exchanged for cash.
Credit Expiry. Credits expire at the end of each calendar month. Unused credits do not roll over. No credit banking, stacking, or cash redemption is permitted.
Bookings Without Credits. If no credit is available, bookings proceed at the full retail rate. Bookings are never blocked for insufficient credits.
4. Pricing and Payment
All prices are in Canadian Dollars (CAD) and are exclusive of applicable taxes including HST. Current pricing is available at brxs.ca/pricing.
Annual Billing. Subscription fees are billed annually upfront. Monthly pricing displayed on our website is for comparison purposes only; the commitment is annual.
Failed Payments. If a payment fails, we will retry up to three times over seven days. If payment cannot be collected, your account will be suspended and bookings will be paused until payment is resolved.
5. Refund and Cancellation Policy
Subscriptions. Subscription fees are non-refundable once the annual term begins. If you cancel mid-term, you retain access to credits until the end of your paid term; no partial refunds are issued.
Booked Shoots. Cancellations made more than 48 hours before a scheduled shoot receive a full credit refund. Cancellations made within 48 hours of a scheduled shoot forfeit 50% of the credit value. Same-day cancellations (within 4 hours of the shoot window) forfeit the full credit value.
Quality Issues. If deliverables do not meet the scope agreed at booking, we will arrange a complimentary re-shoot at no additional credit cost, subject to our review. We do not offer cash refunds for completed shoots.
Platform Failures. If a shoot cannot proceed due to a Bricks platform error or photographer no-show attributable to Bricks, full credit will be restored to your account.
6. Delivery and Turnaround
Standard turnaround is 24 hours from shoot completion for all packages except Luxury and Estate (12-hour rush delivery included). Turnaround times are targets, not guarantees. Bricks is not liable for delays caused by weather, equipment failure, third-party processing delays, or other circumstances beyond our reasonable control.
Deliverables are hosted on the Bricks portal and accessible via shareable links. Storage is included for the duration of your active subscription. Files must be downloaded before account termination; we are not responsible for data loss after account closure.
7. Intellectual Property
Your Content. You own all property information, branding assets, and content you upload to the platform. You grant Bricks a limited licence to use your property addresses and listing information solely to coordinate and deliver your shoot.
Deliverables. Upon full payment, you receive a perpetual, non-exclusive licence to use all photos, videos, and other media produced for your listings for real estate marketing purposes. This licence covers MLS listings, digital advertising, social media, and print.
Portfolio Use. Bricks and the assigned Photographer reserve the right to use delivered images and videos for portfolio, marketing, and platform promotion purposes, unless you opt out by written request to support@brxs.ca.
Bricks Platform. The Bricks name, logo, platform software, and associated intellectual property are owned by Bricks Media Inc. You may not copy, reverse-engineer, or create derivative works of the platform.
8. Prohibited Use
You may not use the Bricks platform to:
- Book shoots for properties you do not have lawful authority to market.
- Circumvent the platform by directly soliciting Photographers introduced through Bricks for a period of 24 months following your last booking.
- Upload unlawful, defamatory, or infringing content.
- Interfere with the operation of the platform or attempt unauthorized access to platform systems.
- Use automated scripts, bots, or crawlers against the platform without written permission.
9. Third-Party Services
The platform relies on third-party service providers for functions including payment processing, data infrastructure, content delivery, mapping, photo enhancement, and post-production. Your use of the platform may involve these third-party services, and your data may be processed by them in accordance with their own terms and privacy policies. Bricks is not liable for failures, data handling, or service interruptions caused by third parties.
10. Disclaimer of Warranties
THE PLATFORM IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. BRICKS DOES NOT WARRANT THAT THE PLATFORM WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE ONTARIO AND CANADIAN LAW, BRICKS DISCLAIMS ALL IMPLIED WARRANTIES INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
11. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, BRICKS'S AGGREGATE LIABILITY ARISING OUT OF OR RELATED TO THESE TERMS OR THE SERVICES SHALL NOT EXCEED THE TOTAL SUBSCRIPTION FEES PAID BY YOU IN THE THREE MONTHS PRECEDING THE CLAIM. BRICKS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR BUSINESS OPPORTUNITY, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
Nothing in these Terms limits liability that cannot be excluded by law, including liability for fraud, gross negligence, or personal injury.
12. Indemnification
You agree to indemnify and hold harmless Bricks, its officers, employees, and affiliates from any claims, losses, damages, or expenses (including reasonable legal fees) arising from: (a) your use of the platform in violation of these Terms; (b) your violation of any applicable law; or (c) any content you submit to the platform.
13. Termination
Either party may terminate these Terms by closing your account. If you terminate before the end of your annual subscription term, no refund will be issued for the unused portion. Bricks may suspend or terminate accounts immediately for material breach of these Terms, non-payment, or conduct that harms other users or the platform.
Upon termination, all licences granted to you cease and you must discontinue all use of the platform. Outstanding payment obligations survive termination.
14. Governing Law and Dispute Resolution
These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to conflict-of-law principles. Any dispute arising from these Terms shall be resolved exclusively in the courts of Ontario.
Before initiating legal proceedings, both parties agree to attempt in good faith to resolve any dispute by written notice followed by a 30-day negotiation period.
15. Changes to These Terms
We may update these Terms from time to time. We will provide notice of material changes by email or prominent notice on the platform at least 14 days before the changes take effect. Continued use of the platform after the effective date constitutes acceptance of the revised Terms.
